Goodnight Construction Site
Submitted by Councilman John Courage on Aug. 8, 2019, this Council Consideration Request (CCR) asks for DSD to review and amend Section 21-52 (a)(6) of the Local Government Code to prohibit exterior overnight construction within 300 feet of an inhabited residential property.
Development Services Department (DSD) has been meeting with stakeholders throughout the last year and a half (we had to pause due to the pandemic in 2020) to provide amendments to the construction noise ordinance to City Council. The proposed ordinance not only sets work hours for construction throughout the city, but also provides means for working outside of these hours when approved by DSD. Part of the approval process includes a requirement that all residents, within 300 ft. of the construction site, be notified of the dates and times work will be completed outside the set work hours (Mon. - Fri. 7 a.m. to 8 p.m.; Saturdays 8 a.m. to 8 p.m.; Sundays 9 a.m. to 5 p.m.).
At last month's meeting to City Council (view presentation), there was discussion on this notification process. Specifically, if the proposed process of notification to a management company or neighborhood organization would be sufficient, or if each individual house would need to be notified.
